Terms and Conditions of Carriage.
1. General Conditions of Use
2.1. These General Conditions of Use regulate the use of the Mallorca Taxi computer application (the "APP") and the website www.mallorcataxis.com (the "Website"), either with its current name or with any other denomination with which it may appear in the future, of Eurocab Travel SL with CIF B16587370 and registered office at Calle Rossinyol 4 07609, Llucmajor, registered in the Mercantile Register of Palma de Mallorca, sheet PM-85769, Volume 2795, Folio 195, (hereinafter "Mallorca Taxi").
2.2. By accessing and using our App and / or Website you ("Client") acknowledge that you have read and accepted these General Conditions of Use and agree to comply with all of its terms and conditions. Likewise, the Client acknowledges and accepts that the access and use of this APP and / or Website will be subject to the General Conditions of Use that are in force at the moment in which he accesses them. Mallorca Taxi reserves the right to modify these General Conditions of Use, as well as any other general or specific conditions that may be applicable. In this case, the Client may notify Mallorca Taxi through the email email@example.com that does not accept any possible modification of these General Conditions of Use.
3. ACCESS AND USE APP
3.1 Access to the "APP" will be subject to registration by the Client through the form ("Registration Form"), which will be previously provided to the Client. Mallorca Taxi reserves the right to freely accept or reject the application for registration by the Client. The data entered by the User in the Registration Form must be accurate, current and true at all times.
3.2 The access and use of the "APP will be subject to a password assigned to the Client by Mallorca Taxi when filling out the Registration Form and access will be made only by the Client who will respond at all times for such access and use.
3.3 The Customer will be responsible at all times for the custody of his password, assuming, consequently, any damages that may arise from its improper use, as well as the assignment, disclosure or loss of the same.
3.4 In case of forgetting the password or any other circumstance that involves a risk of access and / or use by unauthorized third parties, the Customer will immediately notify Mallorca Taxi so that it immediately proceeds to the blocking and replacement of the same In any case, any transactions carried out prior to said communication will be deemed made by the Client, who will be responsible and will pay the expenses and / or damages arising from any access and / or unauthorized use made prior to said communication.
3.5 The user will have at all times proof of reservations made and charged by Mallorca Taxi, since at the time of booking they receive an email with all the detailed itineraries.
3.6 Without prejudice to the foregoing, Mallorca Taxi will make its best efforts to inform the Client of any reservation that shows signs of fraud so that it can verify as soon as possible the existence of any misappropriation or misuse of its account and may, at case, inform Mallorca Taxi of the eventual fraud as soon as possible.
4. RESERVATION PROCESS
4.1 Through the APP and/or Website, Mallorca Taxis provides the Client with a vehicle reservation service with driver ("Service"). The APP and/or Website provide the Client with access to content, information and data provided by the Client in connection with the Service. Mallorca Taxis reserves the right to modify at any time the presentation, the configuration of the APP and/or the Website, as well as the corresponding general conditions of access and use.
4.2 Mallorca Taxis acts as an intermediary on its own behalf in the provision of transportation services to the Client. It shall be the sole responsibility of the third party carriers or drivers to provide the transportation services that are contracted through the APP and/or Website.
4.3 Mallorca Taxis only makes available to the Client a tool for booking transport services provided by third party carriers. The Client exonerates Mallorca Taxis from any responsibility derived from the transport service provided by third party transporters.
4.4 Mallorca Taxis is incorporated as a travel agency and holds the corresponding travel agency administrative certificate and liability insurance derived from its activity.
4.5 The contract between Mallorca Taxis and the Client will be binding for the parties only when the payment has been made correctly. Once the Client has completed the reservation and the payment has been made correctly, he/she will be able to see his/her reservation code on the screen.
4.6 It is the customer's responsibility to check the details of their reservation before traveling and inform us if there are any errors. If you do not receive the email, you can check the status of your booking from "My booking" and you can also request a copy of your booking from firstname.lastname@example.org.
4.7 Mallorca Taxis is not responsible for errors made by the customer regarding dates and times, this may have costs if the vehicle is sent to the customer and the service could not be provided due to errors made by the Customer regarding the time or dates when making the reservation.
4.8 In the event that the transport operator is unable to provide the requested service the client will be informed and the total amount will be refunded using the same system used for payment, and the company will be released from any further obligation to the client.
4.9 Mallorca Taxis requires that the vehicles of the transport companies carrying out the activity comply with any current or future regulations affecting such activity.
4.10 Mallorca Taxis contractually requires that the cabs that carry out the activity have the corresponding civil liability insurance with a maximum limit of 50 million euros. Likewise, Mallorca Taxis undertakes to collaborate with the User in the necessary steps with the transport company responsible for the vehicle in which he/she has suffered any damage, providing the Client with the necessary information to obtain compensation for the damages he/she may have suffered.
5.1 The rates, their updates, and conditions of use will be available at all times on the APP and/or Website and are subject to possible modifications.
5.2 At the moment the Client requests the service through the APP and/or Website, he/she will be able to consult the price of the trip (which will include applicable taxes and supplements), which will be displayed provided that the Client has included the destination point.
5.3 Any extra charge or discrepancy between the price reflected in the price finally charged to the User will be due to the modification by the Customer of the route (and stops) of the requested journey, as well as the excess to the courtesy time that the Customer makes the driver wait according to the type of reservation once he/she arrives at the indicated pick-up point.
6. FORMS AND TYPES OF PAYMENT
6.1 We accept credit cards, American Express, MasterCard, Visa, Visa debit cards, Visa/Electron) and PayPal.
6.2 The form of payment applicable to the type of reservation "PRE-RESERVE" will be a payment of 0€ on account of the reservation at the time as a guarantee and the rest of the amount will be invoiced 24 hours before the first or only transfer.
6.3 The form of payment applicable to the type of reservation "PAYMENT BY CREDIT CARD" will be full payment at the time of booking.
6.3 The form of payment applicable to the type of reservation "PAYPAL PAYMENT" will be full payment at the time of booking plus a 3% administration fee.
6.4 Mallorca Taxis reserves the right to modify, extend, reduce, establish and/or eliminate any payment method at any time as it deems appropriate for the proper functioning of the Service, in which case the User will be notified of such circumstance.
7. RESERVATIONS WITH AIRPORT ORIGIN
7.1 In the reservation form with origin airport the client has to indicate the real time of arrival of the flight, if the client indicates a time later than the landing time, Mallorca Taxis will take as good the time indicated by the client.
7.2 The waiting time at the airport begins at the time of landing of the aircraft, or if applicable at the time indicated by the customer in the reservation, flight delays are not considered waiting time and do not involve any supplement.
7.3 The courtesy waiting time at the airport is 60 minutes after the aircraft has landed.
7.4 If the client does not show up at the meeting point or counter on the date and time agreed at the time of booking, the reservation will be considered a 'no show'.
7.5 If the client shows up at the meeting point or counter on the date and time agreed upon at the time of booking and does not comply with the booking conditions and contractual terms and/or is in debt to this company, the booking will be considered a no show.
7.6 Should the client be unable to locate the driver of his private transfer or the representative of Mallorca Taxis, it is the client's responsibility to contact us by calling the 24h. service telephone numbers stated on his booking voucher. If you do not call these numbers and arrange alternative transport, the service will not be provided, the transport operator will be released from its obligation to provide the service and no refund will be made.
An external telephone service provider records and stores a list of all calls received on our Customer Service numbers, a photographic image of the meeting point and the current waiting time; this list will be used as evidence in case of discrepancy as to whether calls were made to our contact numbers or not. Unused transfers are non-refundable and the costs of alternative transport will only be refunded if pre-authorized by a member of Mallorca Taxis.
8. RESERVATIONS WITH AIRPORT DESTINATION
8.1 The courtesy waiting time at the address indicated by the customer is 15 minutes.
8.2 The Client and the Passenger(s) and any luggage or personal items must be ready for transfer at the time stipulated by the Client when the Reservation is made.
8.3 Failure of the Client to appear at the indicated point at the requested date and time shall be considered a 'no show' and shall not entitle the Client to a refund.
10. VEHICLES, LUGGAGE AND EXTRAS
10.1 The passenger is entitled to transport one piece of baggage per person with a maximum combined size of 158 cm (length + width + height) and the corresponding hand baggage (e.g. a handbag or cabin bag) free of charge.
10.2 If a passenger requires transportation of baggage in excess of this limit and the extra is not available on the website or APP at the time of booking, he/she should contact us at email@example.com requesting what type of vehicle is required.
10.3 At the time of booking you must inform us of the baggage to be transported. It is not necessary to declare smaller items that can be placed on the passenger's footrest such as handbags, backpacks or cameras.
10.4 The Client shall be responsible for any costs incurred in the event that additional vehicles are required for the transportation of persons or luggage not declared on the booking form.
10.5 Mallorca Taxis may subsequently check in to the client luggage not declared in the reservation such as Pets, Golf clubs, Bicycles and additional luggage.
10.6 Unless traveling with a guide dog, animals are only allowed in their carrier and must be declared at the time of booking as pets.
10.7 The transport of bicycles is only permitted if they are in their packaging, we are not responsible for the transport of bicycles without adequate protection and the driver may refuse to transport them for safety reasons.
10.8 The transport of Golf Clubs is only permitted if they are in their packaging, we are not responsible for the transport of Golf Clubs without adequate protection and the driver may refuse to transport them for safety reasons.
10.9 Mallorca Taxis reserves the right to inform the customer if the type of vehicle booked cannot accommodate the specified luggage. In such cases, you may need to upgrade your vehicle type.
10.10 Mallorca Taxis does not accept requests for extras such as pets, bicycles, baby seats, additional stops or waiting time in the driver's comments field, in which case the reservation may be cancelled by us.
10.11 Extras may have a cost and will be indicated at the time of booking.
11. CAMBIOS EN LA RESERVA
11.1 The booking confirmation received by e-mail includes the booked destination, the pick-up point and the address of the accommodation. Any modification affecting this or other data must be communicated by e-mail to the address firstname.lastname@example.org and will only be considered effective once the confirmation of the change has been received by e-mail.
11.2 The Client may request as many changes as necessary without limit and without administration cost provided that they are requested 24 hours in advance.
11.3 MODIFICATIONS OR CANCELLATIONS BY THE CUSTOMER
11.4 Any modification or cancellation of a reservation must be made more than 24 hours in advance by e-mail to email@example.com.
11.5 Partial, leg or complete reservations may be modified or cancelled.
11.6 If your cancellation request is received more than 24 hours before the pick-up time of the transfer service you wish to cancel, you will be reimbursed the full amount corresponding to this transfer.
11.7 No refund will be made if the cancellation occurs less than 24 hours before the scheduled time of the transfer service you wish to cancel. In this case we will send you an email with the confirmation of the cancellation so that you can use it to claim the amount from your tour operator, airline or insurance company.
11.8 If the client does not show up at the meeting point or counter on the date and time agreed at the time of booking, the reservation will be considered a 'no show'.
11.9 If the client shows up at the meeting point or counter on the date and time agreed upon at the time of booking and does not comply with the booking conditions and contractual terms and/or is in debt to this company, the booking will be considered a no show.
11.10 Refunds will be made through the same means of payment by which the reservation was made.
12. CHANGES AND CANCELLATIONS BY US
12.1 If the transport operator is forced to make any significant vehicle changes to the conditions of service, or to cancel the service, we will inform you as soon as possible.
12.2 Reservations made by the Client with incorrect origin/destination will be put on hold and the Client will be notified of the possible solution or rectification.
12.3 Reservations made by the Client with incorrect origin/destination and have a higher cost than the one paid, in case the client does not accept the payment of the difference, the reservation will be cancelled and the amount paid will be refunded.
12.4 In case of flight delays of more than 3 hours, the Client must confirm with Mallorca Taxis the availability of the vehicle.
12.5 Mallorca Taxis reserves the right to cancel a reservation when the flight delay is more than 3 hours and it does not have the means to carry out the service. The amount of the reservation will be cancelled without any cost for the client.
12.6 Si el operador de transporte no dispone del vehículo reservado por el cliente, Mallorca Taxis podrá enviar distinto tipo de vehículo. El vehículo siempre será igual o superior al reservado.
12.7 If the transport operator does not have a vehicle for the reserved seats at the time of booking, the service may be provided with several vehicles until the number of seats reserved by the Client is reached.
12.8 The extras not declared in the reservation and that have a supplement may be cause for cancellation of the reservation to the customer, the customer may pay the payment of the extras or make a new reservation indicating the extras correctly.
13. CHILDREN CHAIRS
In Mallorca Taxis we respect the law. Most countries' laws determine that, if a child measures less than a certain height (usually 1.35 cm), they must ride in a restraint system (child seat) placed in the back of the vehicle.
At the time of booking if you are carrying children or infants, we recommend that for safety reasons you use a booster or baby seat for passengers under 12 years of age or with a height of less than 135 cm. During the booking process you will be able to reserve child seats or boosters on all destinations, with a maximum of 3 seats per trip.
13.1 If you wish to travel with your own baby seat or booster and you have booked a private transfer, you must inform us by email to firstname.lastname@example.org of this circumstance before starting the trip. We must ensure that the vehicle booked is compatible with the seat. For group services, minibuses or coaches are mostly used and in these vehicles it is not possible to use child seats.
13.2 Mallorca Taxis will make every effort to ensure that the driver provides the chair or lift when it has been reserved. There may be occasions when the reserved chair is not available. In such cases, if no seat is available, children over three years of age must use a seat belt. Children under three years of age may travel without a restraint system, but must ride in the rear seats of the vehicle.
14. UNDERAGE CHILDREN
14.1 All children and infants, regardless of age, shall be taken into account in determining the capacity of the vehicle to be used, and therefore must be included in the total number of passengers at the time of booking.
15. ADDITIONAL STOP RESERVE
15.1 During the booking process you will have the possibility to book an additional stop in case you need to pick up or return keys or if your group is split between more than one accommodation. The address of the additional stop must be located in the same destination municipality as the main stop. The maximum duration of this additional stop is 5 minutes.
15.2 45-MINUTE WAITING TIME RESERVE
15.3 During the reservation process you will have the possibility to reserve waiting time in blocks of 45 minutes in case you need to make the purchase, manage documentation etc., the waiting time stop can only be made in the direction of the destination indicated in the reservation.
16. FLIGHT CANCELLATION OR DELAY
16.1 If your carrier has cancelled your flight and you notify our operators by email, phone or chat more than 24 hours in advance, the reservation may be cancelled or modified free of charge.
16.2 If your airline has cancelled your flight with less than 24 hours notice the reservation will not be refunded. Passengers may claim from their airline a financial compensation that varies between 250 € and 600 €, depending on the distance of the flight, although these amounts may be reduced by 50% if the airline offers alternative transport and meets a series of requirements regarding the time of arrival at the final destination.
16.3 If your flight is delayed by more than one hour, Mallorca Taxis will reschedule the Transfer Service and you will be picked up at the new arrival time subject to availability.
16.4 If the User cancels a Trip outside the period stipulated above, the User will be charged the full amount of the Trip regardless of whether the Trip has taken place or not.
16.5 In the event that your flight is delayed, the vehicle will only be available at the scheduled time.
17. APPLICABLE LAW AND JURISDICTION
These General Conditions shall be governed by the Spanish legislation in force.
The contract agreed between you and the company will be regulated in accordance with Spanish law.
For any controversy or claim the company and the customer, expressly waiving any other jurisdiction, submit to the courts and tribunals of the city of Palma de Mallorca.
